Matt Brown, owner of Elite Payroll and other companies, was sentenced on April 25, 2025, in Federal Court to a total of 50 months and ordered to pay restitution for 2 charges filed by the U.S. Department of Justice, Tax Division to which he plead guilty.
His charges were:
- Count 1 – Failure to Account for and Pay Over Trust Fund Tax
- Count 2 – Aiding and Assisting in the Filing of a False Tax Return
For Count 1, Mr. Brown was sentenced to a term of 50 months. For Count 2, he was sentenced to a term of 36 months. The sentences are to run concurrently, meaning he will serve both sentences at the same time so the maximum time he will serve in prison for these counts will be 50 months.
Following his prison sentence, he will be required to be on supervised release for a total of two years.
According to the Federal Bureau of Prisons, Mr. Brown, whose register (inmate) number with the prison system is 44049-511, is currently incarcerated at FCI Edgefield in Edgefield, South Carolina. It is a medium security federal correctional institution that houses a total of 1,248 inmates in the main section of the prison and 511 inmates at the satellite camp.
His release date is posted 11/9/2028. It is unclear if this is the actual date of if there is a correction needed as the original documents filed in the case had a clerical error specific to the sentencing which were recorded on May 8, 2025.
Based on the court hearing and sentencing, his release date should be June 2029.
Civil Case Updates
At the time we originally started covering this story last year, there were 6 cases filed on the Martin County Clerk of Court site.
Four of the cases were not active but two were.
24000680CAAXMX – AARON SCHAMBACK DMD PA vs. AARON BROWN AND ASSOCIATES INC
The case dismissed with prejudice, meaning the case cannot be brought back before the courts.
The case was dismissed because there was a settlement reached between Dr. Schamback and Elite Payroll. They entered into a confidential settlement “that fully resolves all claims, counterclaims, proceedings and issues, brought, or could have been brought in this action.”
23001383CAAXMX – DURASEAL OF THE TREASURE COAST INC vs. AARON BROWN AND ASSOCIATES INC A FL CORP
On April 28, 2025, Elite Payroll filed to have the amended complaint dismissed. That request was denied.
On May 28, 2025, Elite Payroll filed a 10-page “Request for Production of Documents.” The requests are for documents and communications that support the claim of “fraud, breach of fiduciary duties, and unfair and deceptive trade practices,” as claimed in the 12/23/2024 amended complaint.
As of the time of this publication, Duraseal has asked for an extension allowing them for more time to respond to the defense’s request for production of certain documents related to the case.
We will continue to follow this story and keep on eye on the Clerk’s site to determine a resolution in the Duraseal of the Treasure Coast v. Aaron Brown and Associates case as well as if there are any new civil suits filed against Matt Brown or any of his companies.
